Wrongful Death Damages in Maine:
The Maine Legislature is considering raising the cap on wrongful death damages to $500,000.00 from $400,000. The last time that the "cap" was raised to reflect the rising cost of living was in 2000. Wrongful death damages include compensation for lost income that the deceased would have used to benefit the survivors. It also includes money for the survivor's loss of the society and companionship of the deceased. The Maine Trial Lawyers Association strongly supports this change as a measure that works toward the goal of full access to justice in our courts.
